Offg. ASPOs(HQ), MALDA DIVN HAS BEEN TRANSFERRED FINALLY : RELENTLESS UNITED STRUGGLE OF OUR COMRADES YIELDED RESULT

he Officiating ASPOs(HQ) of Malda Division, against whom series of complaints of sexual harassment were recorded by our lady comrades of Malda Division in August 2013, has finally been transferred to Dinajpur Division by the Circle Administration.

       Since his joining as ASP(HQ) in officiating capacity, almost all staff were subjected to his ill behaviour and arrogance. The women employees were the worst sufferers and after tolerating his insulting attitude and behaviour upto a certain level, they were compelled to file complaints of sexual harassment against him in August 2013. But instead of taking immediate action and initiate suitable inquiry on such serious complaints, the administration played different intrigues to delay and to protect him.

    The comrades of Malda Division have fought an inspiring struggle since then and denied to bow down before this indecent officer. Series of demonstrations and other trade union movements were launched in the division. The movement later got momentum and spread across the North Bengal Region and then throughout the Circle. Group-C Circle leadership repeatedly visited Malda and North Bengal R.O. especially on this issue. Demonstration program was also floored at Yogayog Bhavan and the issue was brought into the notice of all tiers of officers. The pressure was gradually mounting on the administration for the transfer of this officer.

    Watching tactical delay and reluctance of the administration, the Circle Union organised a demonstration of women workers at the Circle Office and a resolution was sent from there to the present Secretary (Posts) Smt. Kaveri Banerjee. Circle Union also discussed the matter with Smt. S.S.Kujur, DPS(HQ) and the Chairperson of the Womens' Cell of Circle Office. We have heard that she has also contributed with her observations for action against this officer. At the same time, Circle Union also had a legal consultation to assess the feasibility of legal proceedings against him and administrative inaction despite speaking legal provisions and many Supreme Court Rulings. 

    Under such a pressure, finally he has been ordered to be transferred to Dinajpur Division. The Circle Union holds that it is an inspiring instance of the positive outcome and achievement of demand through controlled but intense, relentless struggle coming out of tremendous unity of our comrades. No word is sufficient for the consistency and patience of our comrades of Malda Division, who faced the whims and arrogance of this offg. ASPOs(HQ) daily, but still carried the fight on. Circle Union also thanks all comrades of other divisions who reacted timely in a befitting manner on the call of Circle Union and participated in the demonstrations.

      Let us take a lesson from this movement and march forward with stronger conviction.

2. Now, it has been decided to hold the above mentioned Examination either on 15th and 16thNovember, 2014 or 22nd and 23rd November, 2014. The exact schedule will be communicated shortly after fixing the venues for conducting the IP and LGO Examinations by the Outsourced Agency.

7th CPC News : Commission's visit to Mussoorie/Dehradun

The commission has, in its first phase of interaction, been seeking the views of various stakeholders on its terms of reference. To this end, meetings have been held in Delhi with various organisations and heads of various agencies.
 
In its second phase of interaction, the Commission has started holding meetings in different parts of the country to facilitate stakeholders staying in various areas to present their views personally before the Commission and ensure larger representation. This exercise is being undertaken to enable the Commission to get a first-hand impression about the functioning and the condition of service prevailing in different parts of the country.
 
Accordingly, the Commission, headed by its Chairman, Justice Shri A. K. Mathur, proposes to visit Mussoorie/Dehradun between 8th October and 10th October 2014. The Commission would like to invite various entities/associations/federations representing any/all categories of employees covered by the terms of Reference of the Commission to present their views.
 
Your request for a meeting with the Commission may be sent through e-mail to the Secretary, 7th Central Pay Commission at secy-7cpc@nic.in. The memorandum already submitted by the requesting entity may also be sent as an attachment with this e-mail.

3% quota must for disabled in all government jobs including IAS: Supreme Court

The Supreme Court today held that three per cent reservation for differently-abled persons be given in all category of government jobs including in appointments and promotions to IAS while pulling up the Centre for "frustrating" the very purpose of empowering legislation by opposing it. 
A bench headed by Chief Justice R M Lodha said the disabled persons have not got their due in the last 19 years after framing of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, which was passed in 1995. 
Additional Solicitor General Pinky Anand, appearing for the Centre, contended that reservation cannot be given in case of promotion to Group A and Group B officers category as it is not a case of appointment. 
The bench, however, observed that appointment is a broader concept and the Centre is giving a narrow interpretation of it. 
"You are frustating the very reservation policy and cause of class for which Parliament passed the law," the bench said. 
"For the last 19 years it is not being implemented and the class, for which the legislation was made, had not got benefited as it should have," the bench said. 
The court dismissed the petition of Centre challenging order of  Bombay High Court which had directed the Centre and the Union Public Service Commission to implement a 3 per cent quota in direct recruitments and promotions for the disabled in the IAS.

I am directed to refer this office letter No. A-34012/03/2014-DE and A-34012/04/2014-DE dated 3rd June, 2014 wherein the notifications for holding Limited Departmental Competitive Examination for promotion of LGO to the cadre of PA/SA for the year 2014 to be held on 21st September, 2014 and LDCE for promotion to the cadre of Inspector posts for the year 2014 on 20th and 21st September, 2014 were issued.

2. The Outsourced Agency, M/s CMC Ltd. has intimated that conduct of the above mentioned examination on the scheduled dates is not feasible. Therefore, the Competent Authority has ordered to postpone both the departmental examinations. The revised dates would be intimated shortly.

Centre May Drop Mandatory Police Verification for Govt Jobs

NEW DELHI: The Centre is considering a move to drop mandatory police verification of candidates selected for government jobs and may accept self-attestation certificates from them.
The issue of omitting the need of police verification of people getting selected for government jobs and applying for passports is under consideration of the Ministry of Home Affairs, official sources said.
The MHA is likely take a view of state governments and other stakeholders in the matter, they said.
A concept note on the matter by the Ministry of Personnel, Public Grievances and Pensions also favoured replacement of police verification in various works including for the purpose of issuance of passport and for government jobs.
It needs to be considered if this can be eliminated as (i) the police check is only about any criminal cases for which the persons concerned do provide necessary declarations and remain liable for false declaration; (ii) the police report is perfunctory as it covers the last place of residence only; (iii) in any case, neighbours' affirmation appears to have little meaning, the note says.
As part of its effort to reform the public service delivery system and bridging the governance deficit, the Centre is promoting self attestation in place of notarized affidavits for a big chunk of government-related work.
Prime Minister Narendra Modi has recently sought minimum use of affidavits and a shift to self-certification, so as to benefit the common man.
"In a citizen-friendly initiative, all ministries and departments of the union government, and all state governments, have been asked to make provision for self-certification of documents in place of affidavits.
"The requirement of attestation by gazetted officer is also sought to be replaced by self-certification by the citizen," the Prime Minister's Office has said in a release.
The 12th report--'citizen centric administration-the heart of governance'--of the second Administrative Reforms Commission has also suggested simplifying procedures for self-certification provision.

DA wef. 1-7-14 has been approved by the Union Cabinet

The Union Cabinet chaired by the Prime Minister, Shri Narendra Modi, today gave its approval for the release of an additional installment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners with effect from 01.07.2014. This is an increase of seven percent over the existing rate of 100 percent of the Basic Pay/Pension, to compensate for price rise. 

The increase is in accordance with the accepted formula, which is based on the recommendations of the 6th Central Pay Commission. The combined impact on the exchequer on account of both Dearness Allowance and Dearness Relief would be of the order of approximately Rs. 7691 crore per annum and Rs.5127 crore respectively in the financial year 2014-2015 (i.e. for a period of eight months from July, 2014 to February, 2015).
