Link pay of government workers with productivity, recommends finance panel

NEW DELHI: The 14th Finance Commission has suggested linking pay with productivity with a focus on technology, skills and incentives, a move aimed at raising the productivity of government employees.

The panel has recommended that in future additional remuneration be linked to increase in productivity.

The Seventh Pay Commission is expected to submit its recommendations by August and it has been asked to look at the issue of raising productivity and improving the overall quality of public services in the country.

The Sixth Pay Commission had also said that steps should lead to improvement in the existing delivery mechanism by more delegation and de-layering and an emphasis on achieving quantifiable and concrete end results. Emphasis is to be on outcome rather than processes, it had said. The earlier Pay Commissions had also made several recommendations to enhance productivity and improve administration.

The 14th Finance Commission's recommendations assume significance at a time when the Narendra Modi government has focused its attention to improve the delivery of public services and is taking steps to use technology to improve efficiency.

The Union government has taken several steps to shore up the bureaucracy and has changed the way attendance is measured in government offices.

"Further we recommend that Pay Commissions be designated as Pay and Productivity Commissions with a clear mandate to recommend measures to improve productivity of an employee," said the 14th Finance Commission headed by former Reserve Bank of India Governor Y.V. Reddy.

The Reddy panel said productivity per employee can be raised through the application of technology in public service delivery and in public assets created.

"Raising the skills of employees through training and capacity building also has a positive impact on productivity. The use of appropriate technology and associated skill development require incentives for employees to raise their individual productivities," the Reddy led panel said.

"A Pay Commission's first task, therefore, would be identify the right mix of technology and skills for different categories of employees. The next step would be to design suitable financial incentives linked to measureable performance," the panel said.

 An internal study by the Commission showed that the expenditure on pay and allowances (excluding expenditure for Union territories) more than doubled for the period 2007-08 to 2012-13 from Rs 46,230 crore to Rs 1.08 lakh crore.

Second and fourth Saturdays to be bank holidays, Remaining Saturdays will be full working days

Second and fourth Saturdays will henceforth be holidays for banks. The remaining Saturdays in a month will be full working days.


This was one of the agreements arrived at the meeting of the Indian Banks' Association with associations of bank employees and staff in Mumbai on Monday.

The agreement, primarily settling the long pending negotiations over the wage revision, led to the United Forum of Banking Unions (UFBU) deferring its four day strike plan later this month.

"It is a balancing act," UFBU (Andhra Pradesh and Telangana) Convenor VVSR Sarma told The Hindu about the agreement on the additional holidays. The influential body of the bank staffers was insisting that all Saturdays should be holidays.

By limiting it to two Saturdays and making other Saturdays full working day, the banks have ensured that the impact on the customers due to the additional holidays is less.

On the key wage revision component, Mr.Sarma said 15 per cent increase is what the IBA has agreed. The negotiations had hit a stalemate after the banks struck to 13 per cent, while the UFBU demanded 19 per cent. According to Mr.Sarma, the cost for the banks due to the 15 per cent hike that has been agreed works out to Rs.4,725 crore.


The agreement on the wage revision would be implemented with effect from November 1, 2012, he added.

Subject:- Revision of rates for various treatment procedures under CGHS.

With reference to the above mentioned subject the undersigned is directed to draw attention to O.M. No. S.11045/36/2012-CGHS (HEC) dated 1.10.2014 whereby CGHS package rates for various treatment procedures were notified by the Government empanelled hospitals under CGHS Delhi and NCR. This Directorate has been receiving representations from different stake holders regarding discrepancies in these notified rates. The matter was examined in this Directorate and now it has been decided with the approval of competent authority to revise the rates of following treatment procedures under CGHS.

 Reimbursement to beneficiaries/empanelled hospitals shall be limited to ceiling rate or as per actual, whichever is lower. The other terms and conditions as regards to CGHS package rates remain unchanged.

2. The revised rates shall come into force from the date of issue and shall be in force till further orders and are applicable in all CGHS cities.

Subject : MODIFIED ASSURED CAREER PROGRESSION SCHEME FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES-instructions regarding,

This Department on the recommendation of Sixth Central Pay Commission in Para 6.1.15 of its report and in supersession of previous Assured Career Progression Scheme, vide O.M. No. 35034/3/2008-Estt.(D) dated 19.05.2009 introduced the Modified Assured Career Progression Scheme (MACPS) for the Central Government Civilian Employees which is operational w.e.f. 01.09.2008. MACP Scheme envisages the three financial upgradations at intervals of 10, 20 and 30 years of continuous regular service to all regularly appointed Group "A", "B", and "C" Central Government Civilian Employees.

2. As per para 6 of DOPT's O.M. No. 35034/3/2008-Estt.(D) dated 19.05.2009, the Screening Committee would follow a time-schedule and meet twice in a financial year preferably in the first week of January and first week of July of a year for advance processing of the cases maturing in that half. Accordingly, cases maturing during the first-half (April/September) of a particular financial year would be taken up for consideration by the Screening Committee meeting in the first week of January. Similarly, the Screening Committee meeting in the first week of July of any financial year would process the cases that would be maturing during the second-half (October-March) of the same financial year.

3. It has come to notice of this Department that the benefits of MACPS are not being granted as per the schedule/provisions in the MACP Scheme leading to dissatisfaction and grievances among the employees. Therefore, Ministrie/Departments are advised to ensure strict compliance to the time limits indicated in MACPS for grant of benefits under this scheme as and when the employees become eligible for such benefits.

LATEST POSITION OF GDS COURT CASE


Delhi High Court has directed Central Administrative Tribunal, Principal Bench, New Delhi to list the GDS case filed by NFPE & AIPEU – GDS (NFPE) for next hearing on 18th March 2014. The High Court also directed that the file of this case should be made available to the Registrar, Central Administrative Tribunal on the above date fixed by High Court.

Supreme Court sets bar on suspension of Govt employees

A government employee can't be kept suspended for more than three months if not formally informed about the charges, the Supreme Court said Monday.


Based on the principle of human dignity and the right to speedy trial, the landmark verdict is expected to affect lakhs of government employees across India, many of whom are under suspension for years pending departmental proceedings.

"Suspension, specially preceding the formulation of charges, is essentially transitory or temporary in nature, and must perforce be of short duration," a bench headed by justice Vikramjit Sen said.

If the charge sheet or memorandum of charges was served within three month, the suspension could be extended, it ruled.

"If it (suspension) is for an indeterminate period or if its renewal is not based on sound reasoning…, this would render it punitive in nature," the court said.

It agreed with petitioner's senior counsel Nidhesh Gupta that a suspension order can't continue for an unreasonably long period.

Protracted periods of suspension had become the norm and not the exception that they ought to be, the court said. It drew a parallel with criminal investigation wherein a person accused of heinous crime is released from jail after the expiry of 90 days if police fail to file the charge sheet.

The suspended persons suffers even before being charged and "his torment is his knowledge that if and when charged, it will inexorably take an inordinate time for the inquisition or inquiry to come to its culmination". "Much too often this has now become an accompaniment to retirement," the court said, setting aside a direction of the central vigilance commission that required departmental proceedings to be kept in abeyance pending a criminal investigation.

The government, however, was free to transfer the officer concerned to any department in any of its offices to ensure the employee did not misuse contacts for obstructing the probe, the court said.

The order came on a petition filed by defence estate officer Ajay Kumar Choudhary, who was suspended in September 2011 for allegedly issuing wrong no-objection certificates for the use of a four-acre land parcel in Kashmir. After failing to get relief from the Delhi high court, Choudhary had moved the top court in 2013.

Since a charge sheet had already been served on Choudhary, these directions would not apply to his case, the court said.

TEARFUL RED SALUTE to Com. S.K.VYAS


   COMRADE S.K. VYAS  NO MORE 

With deep grief and extreme sorrow, it is intimated that Com. S.K.Vyas, the legendary leader of the Central Govt. Employees and   Pensioners, is no more. He passed away at about 08.20 PM on 13 February 2015, at  a Jaipur hospital, where he was admitted a few days back after a massive heart attack. He was recovering, but all of a sudden, the situation worsened and he passed away.
He was 85 years.
His funeral will take place at Jodhpur on 14th Feb 2015. Com.Vyasji was the Secretary General of the Confederation of Central Govt. Employees and workers since 1967 for more than four decades. He was holding the posts of Secretary General of both BCPC and NCCPA, Federations of Pensioners Associations till his end.
His death is an irreparable loss to the entire CGE and Pensioners movement.
Our heartfelt condolences to the bereaved family, friends and comrades.
